The Building Regulations etc. (Amendment) (England) Regulations 2023 (Building Regulations) place responsibility upon all parties within the construction process to ensure that safety is considered from inception to completion of building works but also incorporating future maintenance, cleaning and alteration works.
From 1st October 2023 all new construction projects have to comply with the Building Regulations in all respects; however for projects that have already commenced or have Building Control approval to begin before this date there is an exemption from complying with the new rules.
For all other projects, those currently in design, the below duties will be applicable.
Part of the changes in the Building Regulations is that duty holder roles from CDM have been transposed into the Regulations. Albeit sharing a name, they are distinctive roles pertinent to the Building Regulations. Whilst there is also considerable overlap between the two sets of duty holders there are also some marked differences.
CDM is safety management of the PROCESS of what is being built – a safe project
BSA is safety management of the PHYSICAL characteristics of what is being built – a safe functional building.
